Before you sign or pay

Buy the house.
Check the reality.

A low asking price is not proof of legal ownership, clear land boundaries, good access or a habitable home.

Your protection starts before the deposit

Use an independent Bulgarian lawyer.

Instruct someone acting for you, not simply the seller or the advertising agent. Ask the lawyer to identify the owner(s), review the chain of title, relevant registered burdens, land classification, building status, legal access and the contract before committing funds.

Rules on foreigners acquiring land can depend on the buyer's status and the type of land. Do not assume every British buyer must create a company, or that every plot can be bought personally.

Independent due diligence sequence

Ten checks worth making.

  1. Identity and ownership

Obtain current identification of the registered owner(s) and their legal ability to sell.

  2. Succession and signatures

Ask whether inheritance, joint ownership or absent owners affect who must sign.

  3. Registered burdens

Have your lawyer check mortgages, attachments, rights of use and other encumbrances through the applicable register.

  4. Land classification

Check the actual plot designation and whether your personal status permits the intended acquisition.

  5. Cadastre versus reality

Compare plans, boundaries, buildings and outbuildings with what is physically present.

  6. Lawful access

Verify legal road access and rights of way, not just an informal track used by neighbours.

  7. Building and structural risk

Arrange independent surveys for roofs, movement, damp, services and any alterations.

  8. Utility arrangements

Verify electricity, water, wastewater and outstanding account or connection questions at the address.

  9. Deposit and payment safety

Never rely on screenshots or last-minute account changes. Verify the recipient and contract terms independently.

  10. Completion and aftercare

Confirm notary, registration, tax, ongoing bills and handover records before considering the transaction complete.

Original buyer research workspace

Keep an evidence trail, not a tick-box verdict.

Nineteen topics to discuss with an independent Bulgarian property lawyer, with notes stored only on your device. Never mark a property legally safe just because a checklist is complete.

Before an offer

Choose an independent Bulgarian lawyer

Check they are properly qualified, independent from seller and agent, and experienced with rural property.

Ask your independent lawyer: Ask who the lawyer represents, what checks are included, what they will report in writing, and how their fee is agreed.

Check the buyer's right to own this land

Ownership rights may differ for non-EU citizens and by land classification, especially agricultural plots.

Ask your independent lawyer: Ask the lawyer whether this specific buyer can own the building and each type of land personally, and which lawful structure applies.

Compare title and cadastral identity

A photographed boundary or online map cannot establish title by itself.

Ask your independent lawyer: Ask for cadastral identifier, current plan/sketch, parcel area and confirmation that buildings and outbuildings match the record.

Establish legal access and utilities

Physical access and active connections are not the same as legal rights or guaranteed services.

Ask your independent lawyer: Ask about registered access rights, road maintenance, water source, drainage, electrical account and required works.

Arrange an independent condition assessment

Roof damage, damp, structural movement and unpermitted alterations can change a low-cost property's true cost.

Ask your independent lawyer: Ask an independent surveyor to inspect the property and identify uncertainties and further specialist inspections.

Before any deposit

Request ownership deeds and history

Current and earlier title documents help an independent lawyer assess who may sell the property.

Ask your independent lawyer: Request the seller's ownership deed and relevant earlier ownership documents through your lawyer.

Editorial research checked: 15 October 2026

Check every owner and signature

Joint ownership, spouses and other legal interests can affect consent to sale.

Ask your independent lawyer: Ask your lawyer to confirm the parties entitled or required to sign and any relevant marital-property consents.

Editorial research checked: 15 October 2026

Resolve inheritance and representation

Inherited properties or sales by an attorney can require additional proof of authority.

Ask your independent lawyer: Ask for relevant succession documents or a properly authorised power of attorney where applicable, then have them checked.

Editorial research checked: 15 October 2026

Check registered mortgages and other burdens

A certificate of encumbrances can form part of the lawyer's investigation of liens, mortgages and third-party rights.

Ask your independent lawyer: Request an up-to-date encumbrance check interpreted by the lawyer, including what it does and does not cover.

Editorial research checked: 15 October 2026

Request the municipal tax valuation

The municipality's certificate may be required for the transaction; the property description and liabilities need checking.

Ask your independent lawyer: Ask whether the certificate matches the deed and identifies all relevant owners and municipal tax obligations.

Editorial research checked: 15 October 2026

Check the lawful status of buildings

The house, extension and outbuildings shown on site may not match recorded or authorised works.

Ask your independent lawyer: Ask for permits, status documents and applicable certificates; have a lawyer or qualified specialist assess inconsistencies.

Editorial research checked: 15 October 2026

Review the preliminary contract and deposit

A preliminary agreement can create binding obligations; a payment to an agent or seller is not automatically refundable.

Ask your independent lawyer: Have an independent lawyer review property description, conditions, deadlines, failure clauses and deposit arrangements before signing.

Before transferring funds

Verify who should receive payment

Unexpected account changes, pressure and screenshots can indicate a payment scam.

Ask your independent lawyer: Independently verify agreed payment instructions using a trusted channel, keep records, and ask the lawyer when funds should move.

Before completing

Understand every document you sign

Important Bulgarian-language documents and contractual terms need to be understood before signature.

Ask your independent lawyer: Arrange an independent qualified translator or interpreter where necessary; ask for explanations of anything unclear.

Editorial research checked: 15 October 2026

Check the notary and signing procedure

The legal transfer follows formal notarial steps within the applicable territorial jurisdiction.

Ask your independent lawyer: Ask your lawyer to confirm all parties, documents, authority and conditions are ready for the notarial transaction.

Editorial research checked: 15 October 2026

Recheck title and payment conditions

Circumstances can change between initial due diligence and final signature.

Ask your independent lawyer: Ask your lawyer what up-to-date title, encumbrance and contract checks are needed immediately before completion.

Editorial research checked: 15 October 2026

After signing

Obtain evidence of registration

The Registry Agency describes registration of the executed title deed as a separate stage.

Ask your independent lawyer: Ask your lawyer for the final deed and evidence of registration; retain copies securely.

Editorial research checked: 15 October 2026

Check municipal tax and administrative actions

Property ownership can create local taxes and filings; archived guidance may not reflect every current exception.

Ask your independent lawyer: Ask the municipality or lawyer which declarations, accounts and deadlines apply under current rules; do not rely on outdated online dates.

Editorial research checked: 15 October 2026

Record the physical handover

Your legal transaction and the practical condition of the property are separate matters.

Ask your independent lawyer: Record keys, readings, utilities, access arrangements, insurance, bills and any agreed handover items.

Before a deposit, obtain the independent lawyer’s written cost schedule and ask the notary to identify the municipality’s actual acquisition-tax rate, the official tax valuation, registry charge and tariff-based notarial costs. See our source-backed euro purchase-cost breakdown ↗. A low asking price is not proof of a low taxable valuation.
